Proces zrovnoprávňování neheterosexuálních osob v České republice

The aim of the bachelor thesis is to map the ongoing process of obtaining equal rights for non-heterosexual individuals in Czechia. Most of the text is devoted to three main periods of time - the First Czechoslovak Republic, period of the nineties in twentieth century and the last five years as milestones of the researched topic. The main contribution of this writing is a summarizing description of key actors, organizational structures, government interventions and social phenomena that played an important role in the legislative changes in human right settlement of these minorities to the heteronormative majority. The Thesis offers a chronological analysis of changes in the perception of non-heterosexual individuals in this territory from 1918 to the present days with the historical context preceding it. To demonstrate the standpoints of the society the writing also presents sociological surveys related to the topic.
The prohibition of discrimination in labor relations

In my work I focuse on problem of discrimination and its prohibition in the labour relations. It's necessary to work with this principle in much more wide context than just as principle in above mentioned relations. The principle of discrimination and its prohibition is very close to another pricipl namly principl of equal treatment. Theese two basic principles are premeated in whole legal system and in many basic and important international documents, documents of European law and documents on conctitutional level in many countries, including Czech republic. So, my work deals with this principles on diffrent levels of law and other related matters. The thesis is composed of introduction, seven chapters, each of them dealing with legislation on a different level, other related subjectss and conclusion. The work is arranged logicly from defining basic terminology used in the thesis through the problems with discrimination and its prohibition in international law, law of European Union and in law of Czech republic. Equal treatment and prohibited discrimination against employees

Resumé Equal treatment and non-discrimination are rules that are essential in international law, European law and national law. They are regulated in many international documents, in terms of European law, especially, in the regulations and directives. Czech Republic, as one of the member States of the European Union is obliged to ensure compliance of national law with European law. It was therefore necessary in order to ensure compliance with requirements of the EC / EU in the field of equal treatment and non-discrimination of employees that are regulated in anti-discrimination directives with our national law. This happened by adoption of Act No. 198/2009 Coll., Anti-Discrimination Act, which as a general law governing these principles. In my works I deal with treatment of these principles in the documents of international law and international organizations active in this area in the primary and secondary law of the EC/EU and also the current modification in our legal system. Problems of discrimination in working environment

This thesis deals with the current issue of discrimination in the workplace, especially focuses on discrimination based on age and sex, sexual harassment and bullying in the workplace, legislation that regulates the area of discrimination in labor relations. The theoretical section includes explanations of terms and connections to a given focus and the practical part includes a probe into five large companies examining whether the effects mentioned in the theoretical part actually occur in practice, or how these problems are solved. This probe was in the form of semi-structured interview respondents in their workplaces. The results confirmed the claim that one of the most vulnerable group are women. Larger companies are trying to provide them a variety of advantages as for example flexible-time work, etc. Some companies have confirmed that there were some cases of bullying or sexual harassment in their firm, but these situations have not been solved other than by the dismissal of one of the participants. However, the occurrence of age discrimination was in the surveyed companies not confirmed - despite the theoretical claims and personal experience. Equal treatment and prohibition of discrimination in employment relations and social security systems in Czech and European law Abstract The dissertation deals with equal treatment and prohibition of discrimination in employment relations and social security systems in Czech and European law. In the introductory section the historical context of anchoring the principle of equality into the legal regulation is outlined. The attention is paid on one hand to the social changes in the first half of the 20th century, which led to the protection of equality in Europe, and on the other to the legislative initiatives and the role of justice in the second half of the 20th century. The second part explains the concepts of equality, discrimination, employment relations and social security systems, which are the central motifs of the dissertation. It analyses how these concepts were viewed in the past, how they evolved, and in what forms and manifestations we can come across them today. The third part introduces the Czech and European legislation, which constitute the current Anti-Discrimination law. Emphasis is placed on the assessment of the Czech Anti- Discrimination Act with regard to its almost ten years of effectiveness in the Czech legal order. With regard to its content, my work deals with equal treatment and prohibition of discrimination in the relationships pertaining to labour law when the effort is expended to provide a comprehensive description of these issues with regard to international law as well as national law. The principle of equal treatment is the leading principle of modern world. The principle of equal treatment runs through all areas of law so the principle of equal treatment and non-discrimination belongs to the most important principle of human rights protection. In the introductory part of my work, I am first focusing on the definition of basic terms that are used in this area and that are necessary to be understood. In addition, I was analysing the issues on the background of the documents of international law, law of the European Union, and also legal regulation of the Czech Republic. The Public Defender of Rights as a Gender Equality Body

Diploma thesis "The Public Defender of Rights as a Gender Equality Body" explores the jurisdiction of the ombudsman in the area of equal treatment and prohibition of discrimination (so-called Equality Body). The main focus of the work is the equality of men and women. The methodology used is theoretical-analytical legal analysis. The work starts with a theoretical analysis of basic terms and concepts relating to equal treatment and prohibition of discrimination. The institution and activities of the ombudsman are also defined in theory. This is followed by a legal analysis of three types. The first one is a procedural analysis of anti-discrimination laws (method of their enactment, past, present and proposed laws). This is followed by an institutional analysis of the Czech Equality Body and the impact of the ombudsman in the area of equal rights. The analytical research is concluded with a substantive legal analysis of selected cases decided by the ombudsman. Methods of feminist legal analysis have been predominantly used for the purposes of the analytical research. Racial Discrimination in the Judicial Practice of the Czech Republic

This thesis deals with issues related to decision-making practice of Czech courts in cases where the plaintiff sought protection against racial discrimination in civil proceedings. Specifically, the thesis endeavours - through the analysis of selected decisions of higher courts and the practice of lower courts - to answer the question of whether the judicial practice together with the applicable laws provide sufficiently effective judicial protection of the right to equal treatment. The first part defines the concept of race as discriminatory ground, as this term is used in legislation in a very broad way and contrary to some scientific concepts of race. The second part contains a brief summary of the legal regulation of non-discrimination in international, European and Czech law. This section focuses on the legal framework applied by Czech courts in the decisions discussed and provides a basis for the following analytical part. The third part, which is the key part of the thesis, deals with decision-making practice of the courts with focus on the problematic aspects of protection against racial discrimination in legislation regulating the protection of personal rights.
